GENERAL TERMS AND CONDITIONS

§ 1 Scope of Application, Customer Information

The following General Terms and Conditions (GTC) govern the contractual relationship between Volker Schmidt GmbH & Co. KG and consumers and businesses purchasing goods through our shop at https://shop.FELGE.de/. Any terms and conditions contrary to or deviating from our GTC shall not be recognized by us. The contract language is German.

§ 2 Conclusion of Contract

1. The offers presented on the Internet constitute a binding offer to purchase goods.
2. You may place one or more products into the shopping cart. During the ordering process, you will enter your data and preferences regarding payment methods, delivery terms, etc. The offer to conclude a purchase contract is accepted only when you click the order button.

§ 3 Customer Information: Storage of Contract Text

Your order, including details of the concluded contract (e.g., type of product, price, etc.), will be stored by us. We will send you the GTC, and you may also access them at any time after the conclusion of the contract via our website. As a registered customer, you can access your previous orders through the customer login area (“Orders”).

§ 4 Customer Information: Correction Notice

You may correct your entries at any time before submitting the order by using the delete key. During the ordering process, we will inform you about additional correction options. You may also completely terminate the ordering process at any time by closing the browser window.

§ 5 Statutory Warranty Rights

Statutory warranty rights apply to our goods.

§ 6 Limitation of Liability

We exclude liability for slightly negligent breaches of duty, provided these do not concern essential contractual obligations, damages resulting from injury to life, body, or health, guarantees, or claims under the German Product Liability Act (Produkthaftungsgesetz – ProdHaftG). The same applies to breaches of duty by our vicarious agents and legal representatives. Essential contractual obligations include, in particular, the obligation to hand over the goods to you and to transfer ownership thereof. Furthermore, we are obliged to provide the goods free from material defects and defects in title.

§ 7 Consumer Information: Non-Participation in Dispute Resolution Proceedings

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
