GENERAL BUSINESS TERMS

 

§ 1 domain, customer information

 

The following general business terms govern the contractual relationship between Volker Schmidt GmbH & Co. KG and consumer or entrepreneur who buys goods via Schmidt Revolution accessories shop. Opposing terms or terms which differ from our general business terms are not accepted. Contract language is German.

 

§ 2 contract formation

 

(1) All Schmidt accessories shop offers are binding offers for you when buying our goods.

 

 

(2) You can put one or more articles into your shopping basket. During your order process you add all data and wished regarding payment method, shipping etc. Only by clicking the order button you accept the offer of concluding this purchase agreement.

 

 

§ 3 customer information: saving of contract text

 

Your order with all data (product, price, etc.) regarding your concluded contract is stored. We send your our general business terms but you can find them on our website all time. As a registered customer you are able to access all last orders in your login area (my account – orders).

 

 

§ 4 customer information: correction

 

Your inputs can be corrected before placing an order at any time with the delete key. We inform you about further correction possibilities during your order process. You can cancel it at any time through closing your browser window.

 

 

§ 5 Legalliability for defects

 

Our goods apply to legal liabilities for defects.

 

 

§ 6 Limitation of liability

 

We exclude liability for minor negligence and breaches of duty insofar as these do not represent significant infringements/violations of the contract in terms of duties, responsibilities, damage due to injury, harm to life or limb, health or guarantees according to product liability law. Same applies to neglects of duty of our vicarious agents and our legal agents. Essential contractual obligation is particularly the duty of delivering your acquired goods and make you assume ownership. Furthermore we have to supply you with goods without any material defects or defects in title.

 

 

§ 7 Mercantilejurisdiction

 

Exclusive jurisdiction for all disputes concerning this contract is our place of business, when you are merchant.

 

 

 

§ 8 consumer information: non-participation in dispute resolution

 

We are not willing and are not obligated to take part in dispute resolution at a customer arbitration board.
